The Office of Campaign Finance, which filed a complaint Friday against Council Chairman Kwame “Fully Loaded” Brown’s 2008 re-election campaign with the Board of Elections and Ethics, is hinting that a criminal probe of Brown’s finances may be warranted.

OCF is asking the BOEE to consider referring the Brown complaint to the U.S. Attorney’s Office in addition to administering fines.

The OCF can administer fines on its own, says spokesman Wesley Williams, but can’t refer matters to the feds. Williams said the “severity” of the allegations made in the complaint warranted that the BOEE take over.

“We just thought that further action might be warranted outside the imposition of fines,” says Williams.

OCF’s complaint, posted below for your reading pleasure, notes that Brown’s committee did not comply with “several requests” to hand over records that would verify $175,000 in payments to a contractor and a sub-contractor. The sub-contractor is the sales-coaching firm owned by Brown’s brother, Che Brown.

The complaint also notes that the Brown campaign failed to report that Che Brown had control of a $60,000 “side account” the campaign set up.

Brown is currently indisposed, as he’s currently in a council hearing for proposed new ethics legislation, but has repeatedly characterized the issues with his 2008 campaign as nothing more than bookkeeping errors. His attorney, Fred Cooke Jr., could not immediately be reached for comment.
